General sales conditions
ARTICLE 1: FOREWORDThe site www.datch.fr is a distance selling service provided by the company Datch Distribution with a capital of 7,600 Euros situated at 99 Bd. Henri Barbusse, 78800 Houilles, RCS4888677212, VAT FR32488677212.
The articles sold by datch.fr are parts for replacement, equipment and maintenance destined for English classic cars and in particular for “MINIS” produced between 1959 and 2001, as well as their derivatives.
Our offer also covers the following makes of English vintage cars: Triumph, MG, Jaguar, Austin Healey.
These General Sales Conditions govern the contractual relations between datch.fr and any person visiting their site or making an order, the two parties accepting them without reserve. These General Sales Conditions will take precedence over any other conditions in any other document, unless there is a previous specific exception in writing by datch,fr. Any internaut can consult our General Sales Conditions on the site www.datch.fr (hereafter known as the “Site”). As these General Sales Conditions may be modified, the conditions applicable are those figuring on the Site at the date of your making an order. They apply in metropolitan France, including Corsica. For orders to be delivered out of France, please consult us.
Articles sold by datch.fr may only be installed by a competent person and under his sole responsibility. Datch.fr cannot be held responsible for the consequences of erroneous installation or the use of inappropriate parts on a vehicle.
ARTICLE 2: CONTRACT
2.1 Conditions for making an order
You declare that you are over 18 and are legally competent or that you have parental permission to make an order on the Site.
2.2 Steps to finalise the contract

2.2.2 Prices
The prices of our products are expressed in Euros inclusive of all tax but excluding transport costs. Wherever the order may be made, it must be paid in Euros. Datch.fr reserves the right to modify its prices at any moment but products will be billed on the basis of the tariff in force at the moment the order is registered.
The product offer and the prices shown by datch.fr are valid as long as they are shown on the Site, while stocks last. Any errors or exceptional modifications are beyond our control and will not engage our responsibility.
2.2.3 Price errors
Despite all our efforts, it is possible that a small number of articles on our Site may show a price error. Rest assured that we shall check the prices at the moment of dispatching your article. If the correct price is lower than the price shown on the Site, we will charge the lower price and will send you your article. If the correct price is higher than the price shown, you will be notified and we will cancel your order unless you choose to accept the higher price.
You will understand that we work with products whose stockage can be more than 30 years old; when these run out , new manufacturing are launched, and these will be based on present manufacturing costs and not the costs of old stock. At all events, we must rejoice that there are still manufacturers around to allow us to keep our cars on the road.
Although datch.fr take the greatest care possible, photographs, texts, drawings, information and characteristics illustrating the products are indicative and cannot be considered legally binding. If any errors or omissions occur as a result of change of characteristics by suppliers, datch.fr cannot be held responsible.
2.2.4 Availability
As a start, we would mention that we sell parts for cars which are between 20 and 60 years old; it is not like a Compact-Disc or spares for your smartphone.
Some of our stock or our suppliers’ stock consists of New Old Stock (NOS), that is to say NEW unused parts from the old days, which have been stored for years. Once these stocks run out, the product is no longer available until a manufacturer/supplier begins production again.
To create our catalogue, we work with our own data bases, supplemented with information communicated by our suppliers. As our data base contains more than 40,000 articles, we obviously cannot stock the totality, and our offer is thus dependent on availability of these articles at our suppliers.
All products proposed by datch.fr to its clients are in general available at our suppliers. Only if a supplier definitively ceases to stock an article will it be removed from our offers. In all other circumstances a new order at a future date remains possible.
When there is a non availability of an article ordered, the customer will be notified by e-mail.
In the event of our being unable to supply an article of equivalent quality and price, you may cancel your order.
2.2.5 Payment and Security
We accept two payment methods:
1. By bank card on line : securitised transaction with the Crédit Mutuel payment system.
We never stock the bank card number, and the entire transaction is carried out on the bank’s secure site.
2. By bank transfer. Our banking details will be sent in the email confirming your order.
2.2.6 Order confirmation
When you click on the “Confirm your order” button, you declare that you accept the General Sales Conditions. The data recorded by datch.fr are proof of the all the transactions between datch.fr and its clients.
After you have made your order, we send you an e-mail confirming the details of your order.
On receiving the order, datch.fr checks the order’s conformity and makes some preliminary checks. For certain types of order, proof of identity and address may be requested.
We notify you of your order by e-mail. This e-mail confirms our acceptance of your order and thus establishes the contract between datch.fr and you.
2.2.7 Right of Withdrawal
In conformity with Articles L.120 – 20 and others in the Code of Consumption, you have 14 (fourteen) days to use your Right of Withdrawal without the need to justify your motive nor to pay any penalties except, if necessary, return transport costs.
The fourteen days run from the date of reception of the order.
Reimbursement will be in the form of a credit note for future orders or repayment if the client requests it.
Repayment can be by bank transfer or re-credit to the bank card used for the original payment.
Repayment takes place on the day we receive the returned goods and at the most within 14 days.
We cannot be held responsible in the case of delays due to stock outage at our suppliers. Also, minor differences between the photos, text and illustrations showing articles on our Site and the articles themselves will not engage our responsibility.
We do everything in our power to provide the services mentioned in these General Sales Conditions. We cannot be held responsible for loss of profit, commercial loss, loss of data or loss of earnings or any other indirect damage unforeseeable at the moment of using the Site or at the conclusion of the sales contract between us and you.
2.2.8 Transfer of ownership – Transfer of risk
Transfer of ownership of the goods to the client will only be effective after complete payment of the price by the client, irrespective of the date of delivery of those goods.
On the other hand, transfer of risks of loss or deterioration of the goods is effective as from delivery and reception of the goods by the client.
ARTICLE 3: Data PROTECTION
All information requested from you is necessary to prepare and carry out your requests.
All records relating to datch.fr are registered with the C.N.I.L.
Your personal data details are dealt with according to the law relating to Information Technology, Data and Liberties of 6th January 1978.
At any moment you are entitled to access and rectification or opposition to personal data concerning you. Just contact us by e-mail (giving your name, first name, address and e-mail) at [email protected].
Also, we would inform you that cookies use certain information stored in the memory on your hard disk. This information helps us to establish audience statistics for the Site and to offer you products based on the articles you have already selected on previous visits.
These cookies do not contain any confidential information about you.
ARTICLE 4: Authors’ Rights
The conception, the format, the title and the entirety of the elements contained in the datch.fr Site are protected according to the rights of the author and the brands mentioned.
The title, the conception, the format of the datch.fr Site and also its contents as well as any collection of software, source codes, or other elements contained on the datch.fr Site are the property of Datch Distribution.
Datch.fr does not authorise its visitors to copy electronically or print on paper any of these elements other than to prepare their choices and to make an order to datch.fr. Any other use of elements from the datch.fr Site, including reproduction for any reason other than those mentioned above, modification, distribution or re-publication, without previous written permission from datch.fr, is strictly forbidden and constitutes a fraud.

ARTICLE 5: Licence of access to the website
We give you a limited licence to access the Site for your personal use. You are not in any way entitled to download or modify all or part of the Site without our specific written permission. This licence does not allow you to use for sales or for any other commercial use this Site or its contents (listed products, descriptions, prices, download or copy of information for any other trader, use of data, software, audio items, graphics, images, texts, photos, tools).
This Site or any part of this Site may not be reproduced, copied, sold or exploited in any way for commercial reasons without our specific written authorisation.
You must not use any techniques allowing you to copy a brand, logo or any other information (in particular images, text, maquettes) belonging to us without our specific written permission. You may not use the meta tags or any other “hidden” text containing our name or our brand name without our specific written agreement. Any unauthorised use will end the licence we have allowed you.
We do authorise you, as a non exclusive and revocable measure, to create a hypertext link to our Site on condition that this link does us no harm. This hypertext link could never engage our responsibility, in any way, to the contents of your site. Any use in your link of our logo, our brand name or our graphics requires our express written authorisation.
ARTICLE 6: WARRANTY
For all products purchased on Datch.fr, you benefit from the legal warranty against hidden defects.
In order to know the steps to follow for any problem or failure on a product, you can contact us at the following telephone number: 00 33 1 73 43 54 85 or by email using the contact form. The warranty period is that offered by our suppliers (manufacturer or wholesaler). Usually it is 6 months or 5000 km. We will always do our best to enforce the warranty clause of the product for you, however we are only distributors and as such we will not be able to automatically substitute for the manufacturer for the application of the warranty clause. To be able to benefit from the product warranty, it is imperative to keep the purchase invoice for the product. Warranties do not cover:
• replacement of consumables (bulbs, wiper blades, batteries, brake discs, filters, fuses, brake shoes, brake pads, etc.)
• abnormal or improper use of the products. • faults and their consequences linked to use not in accordance with the use for which the product is intended (competition, etc.).
• faults and their consequences linked to any external cause.
